Scope of application

Any sale on the Site constitutes a distance contract governed by Chapter I, Title III (articles 45 et seq.) of Legislative Decree no. 206 of 6 September 2005 ( Consumer Code ) and by Legislative Decree no. 70 of 9 April 2003, which contains the rules on electronic commerce.

The General Conditions of Sale may be modified at any time. Any modifications and/or new conditions will be effective from the moment they are published on the Site. You are therefore invited to access the Site regularly and consult the most up-to-date version of the General Conditions of Sale before making any purchase.

The applicable General Conditions of Sale are those in force on the date the purchase order is sent.

These General Terms and Conditions of Sale do not govern the sale of products and/or services by parties other than the Company that may be present on the Site via links, banners, or other hypertext links. Before conducting commercial transactions with these parties, you should check their terms and conditions. The Company is not responsible for the provision of services and/or the sale of products by these parties. The Company does not carry out any control and/or monitoring of websites accessible via these links. The Company is therefore not responsible for the content of such sites or for any errors and/or omissions and/or violations of law by them.

You are required to carefully read these General Conditions of Sale as well as all other information that the Company provides on the Site.

Purchases on the Site

Purchasing on the Site

• It can happen either by registering on the site or by express checkout
• It is permitted both to users who have the status of consumers and to users who do not have this status.

Pursuant to Article 3, paragraph 1, letter a) of the Consumer Code, we remind you that consumers are natural persons who, in relation to the purchase of Products, act for purposes unrelated to any entrepreneurial, commercial, professional, or artisanal activity they may carry out.

In the event of orders, from whomever they originate, that appear to be anomalous in relation to the quantity and/or frequency of purchases, the Company reserves the right to take all necessary actions to eliminate the irregularities.

The Company reserves the right to refuse or cancel orders that come from:

• from a user who has been involved in crimes
• from a user who has provided false, incomplete or otherwise inaccurate identification data or who has not sent the Company the documents requested by the Company in a timely manner or who has sent invalid documents

For all shipments to countries outside the European Union , any taxes, fees, or customs duties are the responsibility of the recipient , who must pay them upon delivery. Bottega27's handling of these duties is not included in this policy.

Registration on the Site

To register on the Site, you must fill out the appropriate form, entering the following data:

• residential address
• telephone.

You agree to immediately inform the Company if you suspect or become aware of any improper use or disclosure of your Site login credentials.

The user registered on the Site guarantees that the personal information provided is complete and truthful and undertakes to indemnify and hold the Company harmless from any damage, compensation obligation and/or penalty arising from and/or in any way connected to the user's violation of the rules regarding registration on the Site or the storage of registration credentials and/or the provision of false, incomplete or otherwise inaccurate personal data, without prejudice to the Company's right to proceed with disabling the user's account.

Information aimed at concluding the contract

In accordance with Legislative Decree no. 70 of 9 April 2003, which contains provisions on electronic commerce, the Company informs you that:

• To conclude a purchase contract on the Site, you must complete an order form in electronic format and send it to the Company electronically, following the instructions that will appear from time to time on the Site.
• the contract is concluded when the order form reaches the Company's server
• Once the order form has been received, the Company will send you an order confirmation to the email address indicated, containing:
  • the price indication
  • the indication of delivery costs
  • the indication of the delivery term.

Product Availability

IMPORTANT: Products may be available for sale even if they are not in stock, with the words "available soon" on the product sheet, as they will be available again within a few days.

The Products offered on the Site are limited in number. Therefore, due to the possibility of multiple users purchasing the same Product at the same time, the ordered Product may no longer be available after the purchase order has been submitted.

The Site contains information regarding the availability of each Product.

You will be notified if the ordered Product is unavailable. In this case, you will be entitled to terminate the purchase contract pursuant to and for the purposes of Article 61, paragraphs IV and V, of the Consumer Code.

Alternatively , you may accept:

• if restocking is possible, an extension of the delivery terms, offered by the Company, with indication of the new delivery term
• if restocking is not possible, the Company will supply a different product, of equivalent or higher value, upon payment, in the latter case, of the difference, and subject to the express acceptance of the user
• The Company will offer a discount coupon to be used for purchases on the Site. The amount of the discount coupon, the deadline for its use, and any limitations will be communicated by the Company from time to time.

If a refund is requested for the amount paid for the purchase of Products that subsequently prove unavailable, the Company will make the refund within a maximum of 10 working days.

If you exercise your right of termination pursuant to Article 61, paragraphs IV and V, of the Consumer Code, the contract is terminated. If payment of the total amount due, consisting of the price of the Product, shipping costs, if applicable, and any other additional costs resulting from the order ( Total Amount Due ), has already been made, the Company will refund the Total Amount Due in accordance with the provisions of the "Payment Methods" section below.

Information Sheet

Each product is accompanied by an information page illustrating its main features ( Information Sheet ). The images and descriptions on the Site reproduce the Product characteristics as faithfully as possible. Product colors, however, may differ from actual colors due to the settings of the computer systems or computers you use to view them. Furthermore, the Product images in the Information Sheet may differ in size or in relation to any accessory products. These images should therefore be considered indicative and subject to customary tolerances. All information in the product sheets is provided directly by the manufacturer.

Prices

All Product prices published on the Site are inclusive of Value Added Tax.

The Company reserves the right to change the price of the Products at any time, without notice, it being understood that the price charged to you will be the one indicated on the Site at the time of placing the order and that any variations (increases or decreases) subsequent to the transmission of the order will not be taken into account.

Shipping costs, if any, are often variable but are always expressly and separately indicated on the order form, before the user proceeds with the transmission of the same.

Purchase orders

The Company will ship the Products only after receiving confirmation of payment authorization or credit of the Total Amount Due. Ownership of the Products will be transferred to you upon shipment, meaning the moment the Product is handed over to the carrier (courier). The risk of loss or damage to the Products, for reasons not attributable to our Company, will be transferred to the buyer when the buyer, or a third party designated by the buyer and other than the carrier (courier), physically takes possession of the Products.

The purchase agreement is terminated upon non-payment of the Total Amount Due. Unless otherwise agreed in writing with the buyer, the order will be cancelled.

The charge will be made only after (i) the details of your payment card used for payment have been verified and (ii) the company issuing the payment card you used has authorised the charge.

Confidential payment card information (card number, cardholder name, expiration date, security code) is encrypted and transmitted directly to the payment processor without passing through the Company's servers. The Company therefore never accesses or stores, even if you choose to store such information on the Site, the payment card information used to pay for the Products.

The charge will be made when the order is sent.

You can also make purchases on the Site using PayPal. If you choose PayPal as your payment method, you will be redirected to www.paypal.it where you will make the payment according to the procedure established and regulated by PayPal and the terms and conditions agreed upon between you and PayPal. The data entered on the PayPal site will be processed directly by PayPal and will not be transmitted or shared with the Company. The Company therefore has no access to, and does not store in any way, the payment card details linked to your PayPal account or the details of any other payment instrument connected to that account.

If you pay by PayPal, the Total Amount Due will be charged to you by PayPal upon completion of the contract via the Site. In the event of termination of the purchase contract or in any other case of refund, for any reason, the refund amount due to you will be credited to your PayPal account. The time it takes for the payment method associated with that account to be credited depends exclusively on PayPal and the banking system. Once the credit order has been placed to that account, the Company cannot be held responsible for any delays or omissions in crediting the refund amount. You must contact PayPal directly to dispute any such delays or omissions. Any refunds made pursuant to these General Terms and Conditions of Sale will be credited to your PayPal account.

Delivery of Products

There are no limitations on delivery, except in cases where indicated on the Website and/or in the Product Sheet.

Shipping costs are indicated from time to time on the Site and/or in the Product Sheet.

From the date of order receipt, products will be shipped within 48-72 business hours (or on specific days where specified depending on the production of fresh products). Bottega27 is not responsible for delays caused by third-party production and/or shipping companies; however, we will inform the customer of any significant delays.

It is the buyer's responsibility to verify the condition of the delivered Product. Without prejudice to the fact that the risk of loss or damage to the Product, for reasons not attributable to our Company, is transferred when you, or a third party designated by you and other than the carrier, physically takes possession of the Product, the Company recommends that you verify the number of Products received and that the packaging is intact, undamaged, not wet, or otherwise altered, including the sealing materials. In your best interest, you are invited to indicate any anomalies on the carrier's transport document, accepting the package with reservations. If the packaging shows obvious signs of tampering or alteration, it is advisable to promptly notify the Company. In any case, the provisions regarding the right of withdrawal (if applicable to the Product) and the legal guarantee of conformity remain applicable.

Right of withdrawal

If you make a purchase on the Site, unless otherwise indicated, you do not have the right of withdrawal provided for by Article 52 of the Consumer Code with reference to the Product or Products indicated in this article. In fact, on the Site are:

• sold goods that are liable to deteriorate or expire rapidly
• sold goods which, after delivery, are by their nature inseparably mixed with other goods.
